1. Competition and organizer
The organizer of the competition is Model GmbH, Stockholmer Straße 40, 48455 Bad Bentheim (hereinafter referred to as the organizer). Participation is exclusively subject to the following conditions of participation.
2. Participation
a) Any person aged 18 or over who is resident in Germany, Belgium, the Netherlands or Luxembourg is eligible to take part.
b) Participation in the competition is only possible from 13.03.2025 to 31.05.2025.
c) In order to participate in the competition, the following condition must be fulfilled by the user: The participant concludes a purchase contract for one or more items in the Model GmbH online store. Participation by other means is not permitted. Incorrect information or incomplete entries will not be considered. The organizer cannot be held responsible for late or incomplete entries.
d) By taking part in the competition, the participant agrees to these conditions of participation.
3. Implementation and processing
a) The following prizes will be raffled off among all valid entries: 3x high-quality JBL headphones.
b) The campaign starts on 13.3.2025 and ends on 31.05.2025.
c) The winner will be drawn on the first working day after 31.05.2025 and notified by e-mail; the winner must confirm receipt of the prize notification and claiming of the prize within two weeks of notification of the prize using the contact details provided in this notification. If this confirmation is not received, the prize will be awarded to another competition participant.
d) The entitlement to the prize also lapses if the prize cannot be sent within four weeks of the first notification of the prize for reasons for which the winner is responsible. The prize will only be sent within Germany, Belgium, the Netherlands and Luxembourg. If, after the winner has been drawn, it transpires that the winner does not have the necessary postal address within Germany, the Netherlands, Belgium or Luxembourg as stated in the conditions of participation, the prize will be awarded to another competition participant.
e) The claim to the prize cannot be assigned and is not transferable; furthermore, the prize cannot be paid out, amended or changed. If the prize cannot be made available for any reason whatsoever, the organizer reserves the right to award a substitute prize of equal value
f) The competition may be terminated due to external circumstances without the participant being able to derive any claims from this.
4. Exclusion of participation
a) In the event of a breach of these conditions of participation, the organizer reserves the right to exclude participants from the competition.
b) Furthermore, the organizer reserves the right to exclude participants who use unauthorized aids or otherwise gain an advantage through manipulation. This is the case, for example, if automatic scripts, hacker tools, Trojans or viruses are used, or if a participant gains an advantage by other unauthorized means. Furthermore, untrue personal details and the use of “fake profiles” can lead to exclusion. In such cases, prizes may also be subsequently withdrawn and/or reclaimed.
5. Facebook
a) The competition is in no way connected to Facebook and is in no way sponsored, supported or organized by Facebook.
b) Participants have no claims against Facebook arising from participation in the competition or from winning the competition.
c) Inquiries and comments by participants are to be directed exclusively to the organizer and not to Facebook.
6. Instagram
a) The competition is in no way connected to Instagram and is in no way sponsored, supported or organized by Instagram; the participant has no claims whatsoever against Instagram. In this respect, the provisions of point 6 apply accordingly.
7. LinkedIn
a) The competition is in no way connected to LinkedIn and is in no way sponsored, supported or organized by LinkedIn; the participant has no claims whatsoever against LinkedIn. In this respect, the provisions of point 6 apply accordingly.
8. Data privacy
The organizer collects, processes and uses the personal data (name, address) provided by the participants when taking part in the competition in order to carry out the competition, in particular for the purpose of sending the prize to the winner.
The organizer reserves the right to use the winner's data for advertising purposes. Participants agree to the use of their data for this purpose.
The data processing is therefore based on Art. 6 para. 1 lit. b) GDPR. For details on the type and scope of data processing, please refer to our detailed privacy policy.
The responsible body or controller within the meaning of the BDSG or the GDPR is the organizer of the competition:

Of course, every participant has the right at any time to request information about the personal data stored by the organizer in accordance with Art. 15 GDPR. The same applies to the deletion of the corresponding data at the organizer in accordance with Art. 17 GDPR, as well as the correction in accordance with Art. 16 GDPR and blocking of the data in accordance with § 18 GDPR.
You can also object to data processing which the organizer bases on Art. 6 para. 1 lit. e or f GDPR under the conditions of Art. 21 GDPR. Of course, you also have the right to lodge a complaint about the processing of your data with the competent supervisory authority.

9. Liability of the organizer
a) The organizer is not liable for damages caused by errors, delays or interruptions in transmission, malfunctions of the technical equipment and service, incorrect content, loss or deletion of data, viruses or in any other way during participation in the competition, unless such damages were caused intentionally or through gross negligence by the organizer (its bodies, employees or vicarious agents). The above limitation of liability shall not apply in the event of injury to life, limb or health or in the event of fraudulently concealed defects. The competition is subject exclusively to German law. Legal recourse is excluded.
b) In accordance with Directive 2013/11/EU, the EU Commission is setting up an internet platform for the online settlement of disputes (“ODR platform”) between traders and consumers. This can be accessed via the following link: http://ec.europa.eu/consumers/odr. However, Model GmbH would like to point out that it is generally not prepared to participate in an arbitration procedure.
10. Concluding provisions
a) Legal recourse is excluded.
b) German law applies.
c) Should any of these provisions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic meaning and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
